Competition Rules

1.      Important

Before you enter into this competition you must have your parents’ permission.

2.      Introduction

Argo Marketing CC is running a promotional competition called Future Stars (“Competition”). By completing the entry form and submitting your details you stand a chance to win amazing prizes.  You can also view these Rules on our website at www.sastudy.co.za  Please read these rules carefully. They set out the terms of the Competition. We have written some important terms in bold. Please pay special attention to them.

3.      Definitions

In this Agreement

3.1      Participant or you means the person who submitted their details to the Promoter on the entry form on www.sastudy.co.za.

3.2      Promoter or Argo means Argo Marketing CC any agency or third party contractor used to promote this Competition.

4.      Duration

4.1      The Competition starts on {insert date} 2012 and ends on {insert date} 2012.

5.      Who can enter this competition?

5.1        You can enter this competition if you:

·      are between 12 and 20 years old and you have valid identification (ID book, birth certificate or valid passport);

·      are between grade eight to 12 at any school, college or similar secondary institution in the Western Cape;

·      have your parents or legal guardian’s permission if you are younger than 18; and

·      you are a South African citizen.

5.2      No person who is a director, employee or agent of or consultant to Argo or who is a spouse, life partner, mother, father, brother or sister, business partner, or associate to a director, employee or agent of or consultant to Argo may take part in or enter this Competition.

5.3      If we ask you to, you must give us an affidavit that confirms that you qualify to enter the Competition.

6.      How to enter

6.1      We will advertise the Competition through various printed publications, on DSTV and on the website www.sastudy.co.za.

6.2      To enter the competition you must complete the entry form on the website www.sastudy.co.za.

6.3      We are not liable for any technical failure that may cause an entry not being successfully submitted.

6.4      Consumer Protection Act. Under the Consumer Protection Act, we need to keep records of the Competition. We (or one of our subcontractors or affiliates) will keep these Rules for three years as required by the Consumer Protection Act.

7.      Promotional Competition Reward

Prizes. You could be one lucky winner to win one of the following prizes {insert prizes}

8.      Prize winner selection and publicity

8.1      Choosing a winner. A panel of judges will choose the finalists who will go into the final stage based on {please insert what the criteria are for deciding a winner}

8.2      Stages of the competition. After the Competition closes and the judges have chosen their 10 finalists, the 10 finalists will move onto the next stage of the competition..

8.3      The public will be allowed to vote for their favourite on the sastudy facebook page  and on www.sastudy.co.za.

8.4      The top five finalists will then be eligible to win a prize.

8.5      The voting phase of the competition will take place after the competition has closed.

8.6      Announcement of winners. The prize winners will be announced after the public voting and approximately two weeks after the Competition has closed. The final award date will be confirmed within two weeks after the close of the competition.

8.7      Independent adjudicator. The Promoter will appoint an independent person (who has to be a representative of an independent accounting firm, a registered auditor’s firm, attorney or advocate) to oversee and verify the draw results.

8.8      Contacting prize winners. Each winner will be contacted telephonically after they have been selected. In order to claim the prizes, the winners must give the Promoter a valid South African Physical Address and ID Number so that the prize can be delivered to them.

8.9      Forfeiting of prize. If the Promoter cannot get hold of a prize winner in seven days they will forfeit the prize and the Promoter may look at the next Participant that has the most public votes. Please check the website regularly and let us know if your details change.

8.10    Receipt. Winners and their parents or guardians (if they are under 18) will need to sign a receipt that they received the prizes.

8.11    Correct details. Winners, who do not give the Promoters the correct delivery details in one month of the being notified, will forfeit the prize.

8.12    Promotion. Winners’ names will be published on the website www.sastudy.co.za. Prize winners may be requested to take part in publicity connected to this Competition. The prize winners grant permission for the use of their names and photographs in any advertising and promotional material for this Competition.

8.13    You are not entitled to any remuneration for taking part in this Competition, or in any media format or appearances associated with it.

8.14    The prizes are not transferable. The Promoter reserves the right to substitute any prize with another prize of similar value.

8.15    Contact. Entrants with questions about the Competition or the prizes can contact us at {insert} or phone us on {insert}.

9.      Breach and termination

If a party breaches the agreement and does not fix it within seven days of receiving notice from the other party to do so, the innocent party may:

  • claim specific performance of this agreement (make the party comply with this agreement); or
  • immediately cancel this agreement in writing; and
  • claim damages from the other party, including any claim for any fees already due.

10.    Resolving disputes

10.1    Arbitration. If there is a dispute and the parties cannot come to an agreement, they must refer the dispute within 15 business days to arbitration under AFSA’s latest rules for expedited arbitrations. The arbitration will be held in English in Cape Town.  The parties will agree and appoint one arbitrator.  If the parties cannot agree on the arbitrator in10 business days after the referral, AFSA will appoint the arbitrator.

10.2    Other dispute resolution channels. Nothing in this clause or Agreement will preclude any party from instituting action in the appropriate court or approaching the National Consumer Commision or relevant ombudsman.

10.3    Urgent interim relief.  This clause will not stop a party from applying to court for urgent interim relief (temporary help) while the dispute resolution process is being finalised. An example might be an interdict (type of court order).

10.4    Severability.  This clause is separate and divisible from the rest of this agreement and remains effective even if this agreement ends or is invalid.

11.    Notices and domicile (Address for the delivery of legal notices)

11.1    Notices.  The parties will send all notices, authorisations, disclosures, acknowledgements, or requests by hand delivery, prepaid registered post, fax, or email to an address or number given in the entry form.

11.2    The Promoter chooses their domicilium for the delivery of legal notices at {insert}

11.3    The Participant chooses their domicilium address as set out in the entry form.

11.4    Change of addresses or numbers.  Each party may change the addresses or numbers in the specific terms to any other addresses or numbers in South Africa by writing to the other party 14 days before the change.

11.5    Deemed delivery. Notice will be considered to be delivered on the date shown on any hand-delivered, prepaid registered post, courier, fax or email confirmation of delivery.

11.6    Notice actually received. If a party actually receives any notice or other communication, this will be good enough.

12.    Force Majeure (Acts not in a party’s control)

12.1    Parties not liable.  No party will be responsible for any breach of this agreement caused by circumstances beyond its control, including flood, fire, earthquake, war, tempest, hurricane, industrial action, government restrictions, or acts of God.

12.2    Party affected to notify other party.  If there is an event of force majeure, the party affected will tell the other immediately, and they will meet within seven days to negotiate other ways to carry out any affected responsibilities under this agreement. The parties will continue to comply with the responsibilities that are not affected by the circumstances.

13.    Assignment and subcontracting

13.1    Assignment. We may assign this agreement to any successor or purchaser of our business or some of its assets.

13.2    Our third party contractors.  We may sub-contract or delegate our obligations under this agreement to third party contractors.  We will remain liable for performance of the third party contractors.

14.    General Rules

14.1    No liability. By taking part in this Competition all Participants agree that they will not hold the Promoter, its associated companies, agents, or contractors associated with this Competition liable for any losses, harm, damages, injury, claims or actions related to this Competition.

14.2    Changing the rules. The Promoter may change these rules by publishing it on the competition site www.sastudy.co.za.

14.3    Breaking the Rules. If a Participant breaks these Rules, the Promoter may disqualify them from the Competition.

14.4    Final determination. The Promoter’s judge’s determination is final and no correspondence will be entered into.

14.5    Tax. Income or other taxes relating to the prizes, if any, are the sole responsibility of the prize winner.

14.6    Use of personal information. Participants understand and agree that in order to offer the Competition, Promoter must collect and use personal information about them. The Promoter will not use the Participant’s personal information for anything other than for administrating this Competition.

14.7    Termination of the Competition. If required to do so, because of legislative or regulatory reasons, this Competition may be terminated immediately and without notice. In the event of such termination all Participants agree to waive any rights they may have as a result of the termination and acknowledge they will have no recourse against the Promoter, its associated companies, agents or contractors associated with this Competition arising out of such termination.
